After the Commercial Court (judgement 17 October 2022), the Paris Court of Appeal ruled in favour of CHANEL, condemning JONAK for parasitism.
CHANEL had accused JONAK of launching 6 models of two-tone beige and black shoes, and a sandal with a chain intertwined with leather, evoking in particular the use of the beige and black identity code and the effect of range.
In addition to the statute of limitations, JONAK argued that the combination of black and beige could not be appropriated, and that the black toe of a shoe is a common feature in the footwear sector.
The Court found that JONAK had deliberately sought to evoke CHANEL’s products in order to capitalise on their luxury image, noting that these practices harmed the appeal of CHANEL’s emblematic codes, damaging its reputation and the brand’s prestigious image.
JONAK was ordered to pay CHANEL €150,000 in compensation for economic loss and €30,000 in compensation for non-material loss.
